Time Limits on Grievances

Many faculty members are not aware of the following two provisions of the UPI-WIU Agreement:
6.11 b. (1) A grievance shall be filed with the Academic Vice President within 40 days following the date of the act or omission giving rise thereto, or the date on which the employee knew or reasonably should have known of such act or omission if that date is later.
6.9.
Stopping the Clock
The grievance clock shall stop between academic terms (Fall semester,
Spring
semester, and Summer Session) or upon mutual consent of the Union and
the
University.
These two provisions are essentially important if a faculty member believes he or she is not being treated according to contract provisions. If a grievance is not filed within 40 CALENDAR day of the grievable incident, or when the faculty member becomes aware of the grievable incident, a grievance may not be filed and the faculty member may not correct the problem. Additionally, it is important to know that the 40 day “clock stops” running during semester breaks and summer. In other words, days during those three times do not count towards the 40 day limit.
