Thomas: Pension Ruling

Dear Campus Community,
On Wednesday, May 14, a temporary restraining order was entered in Sangamon County Circuit Court, which blocks the implementation and administration of any provisions of Public Act 98-599 ("Pension Reform Law") that was passed in December 2013. This injunction requires that no implementation shall occur until the court issues a final ruling on the merits of the Act's constitutionality. The judge acknowledged that "irreparable harm" may be caused if the law had been implemented before questions over its constitutionality are resolved.
Depending on the outcome of the court's decision, provisions of the new law may still be implemented in the future. However, at this time, the ruling preserves the current pension system. The injunction provides assurance for employees who were considering retirement before June 30, 2014, to avoid losing pension benefits.
