Article 42: Salary, Unit B

42.1. Basic Increase

  1. Effective September 1, 2001 for Associate Faculty and July 1, 2001, for Academic Support Professionals, the Board will grant each Unit B employee, under contract and eligible under 42.2, a salary increase of 10 percent of the employee's 2000-01 basic monthly salary.
  2. Effective September 1, 2001, salary minima as specified in Article 43.1 and Article 43.2 will be increased. Associate Faculty who have earned promotion to Senior Associate Faculty or Assistant Professor will be granted an increase as specified in 43.3.
  3. The 0.25 percent awarded as a result of UPI's arbitration of the FY2001 settlement is included in this FY2002 settlement (as provided for in 42.1.a and 42.1.b above). UPI agrees to accept all previous compensation payouts as final. There will be no more claims initiated by UPI as a result of this arbitration.

42.2. General Eligibility

  1. In addition to any special conditions provided in Article 43 regarding eligibility for the salary increases specified, and except as provided in paragraph 42.2.b. below, an employee of the University shall be eligible for the salary increases specified in Articles 42 and 43 only if she or he is employed in a position in the bargaining unit as of the date of the ratification of this Agreement by the Board and the Union or September 1, 2001, whichever is later, and one of the following additional conditions:
    1. ) is an Academic Support Professional who was employed prior to July 1, 2001, in either a position described in Appendix B or in a position which has been newly classified as a bargaining unit position effective in fiscal year 2002; or
    2. ) is an Associate Faculty member employed as a temporary faculty member or Associate Faculty member the previous academic year; or
    3. ) is returning to a previously held bargaining unit position following employment in a permanent full-time position at the University for at least one academic term during the 2000-01 academic year.
  2. An employee shall not be eligible for the salary increases specified in Articles 42 and 43 if prior to her or his employment in a position in the bargaining unit the employee has received a salary increase from the University for FY2002.

Article 43: Additional Compensation, Unit B

This Article shall be in effect from September 1, 2001, through August 31, 2005 except as provided in Article 15 (Duration).

43.1. Salary Minima for Associate Faculty The following minimum monthly salary shall be paid to a full-time Associate Faculty member who, as of September 1, 2001, possesses the specified degree or has the specified status/rank, and has completed the specified years of service in a professional position at the University as follows:

43.2. Salary Minima for Academic Support Professionals

The minimum monthly salary shall be awarded to an employee who, as of July 1, 2001, holds the specified degree, serves in a position designated by the appropriate University Vice President as a position requiring or preferring that specified degree, and is in the specified year of employment at the University in a professional position as follows:

These minimum salaries shall apply pro rata to employees whose appointments are less than full-time.

43.3. Promotion for Associate Faculty In addition to the salary increase specified in Article 42, the Board will grant the following amounts for promotion, effective September 1, 2001:

  1. ) $50/month for promotion to Assistant Professor;
  2. ) $50/month for promotion to Senior Associate Faculty.

43.4. Initial Appointment

A person who receives an initial appointment to a position in the bargaining unit shall be appointed at a salary at least equal to the applicable minimum salary for her or his qualifications specified in this article, as appropriate.

43.5. Summer Session Salaries

A summer session assignment shall be compensated on the basis of the employee's monthly salary for May of the immediately preceding academic year. An employee shall receive one month's salary for an assignment of three academic credit equivalents (ACEs). Assignments of more than three ACEs shall be compensated on an overload basis.

43.6. Grant/Contract Salaries If an employee is assigned work on an externally funded grant or contract, the work may be excluded from her or his assigned obligation if approved by the appropriate Dean. For all such grant or contract work so excluded an employee may earn up to a total of 40% of her or his basic salary in a twelve month period. This amount shall be in addition to the employee's basic salary.

43.7. Counteroffer

Academic Support Professionals may apply for a counteroffer.

  1. The University President may approve a salary increase to retain an employee who has received a bonafide offer of other employment which the University President has verified with an appropriate official. The employee's monthly salary following the effective date of an increase under this paragraph shall not exceed the amount of the monthly starting salary offered to the employee by the other employer.
  2. The effective date of the increase provided in 43.7.a. above shall be no sooner than the first day of the academic term which immediately succeeds the approval of the counteroffer by the University President.
  3. An employee shall not be eligible to receive a salary increase under 43.7.a. above until her or his fourth year of full-time employment at the University. An employee who receives an increase under 43.7.a. above will not be eligible to receive another such increase until the fourth year after the increase.
  4. An employee who receives an increase under 43.7.a. above shall be eligible for the increases specified in Article 43.2 if the employee is otherwise eligible for the increase under the terms of the Section and under the terms of Article 42.2.
  5. An employee who receives an increase under 43.7.a. above shall be eligible to receive the difference between the increase under 43.7.a. above and the increase specified in Article 42.1. if:
    1. ) the increase under 43.7.a. above is less than the increase specified in Article 42.1.; and
    2. ) the employee is otherwise eligible for the increase specified in Article 42.1. under the terms of Article 42.2.
  6. Each employee who receives a salary increase under 43.7.a. above shall agree to serve the University for at least two academic years subsequent to the academic year in which the increase is received and shall give a judgment note to the Board of Trustees for the amount of the increase, said judgment note to be cancelled at the end of the required period of service or at the death or permanent disability of the employee.
  7. Within 30 days after the approval of an increase under 43.7.a. above a report shall be submitted to the Union President and the appropriate Vice President. The report shall contain the name of the employee to be awarded such an increase, a copy of the offer received by the employee and the amount of the increase. In the event the offer has not been in writing and if the offer has been from an academic institution, the report shall include the name of the official with whom the University President has verified the offer.
  8. The approval of or failure to approve an increase under Article 43.7.a. above shall not be subject to the grievance procedure specified in Article 6. The Union may file a grievance concerning any other aspect of Article 43.7. The grievance 100 must be filed within the time limit for filing a grievance specified in Article 6.11.b.(1).

43.8. Transfer and Reassignment Adjustments

The University may adjust an employee's salary based upon transfer or reassignment in accordance with paragraphs a. and b. below. An employee may request an adjustment by notifying in writing the appropriate University Vice President of the desired adjustment. The employee may include endorsement by her or his supervisor(s) in the request. If the request is honored, the salary increase shall take place at the beginning of the next term of employment. If the request is denied, the employee will be so notified, in writing, by the appropriate University Vice President. Such request shall not be unreasonably denied.

  1. The salary of an Academic Support Professional who assumes a position with expanded responsibilities may be increased to a level comparable to the salaries of other employees with comparable responsibilities.
  2. Within 30 days after the granting of an increase under this Section, the Union President shall be notified of the name of the employee granted the increase, the reason for the increase, and the amount of the increase.

43.9. Overload

An Associate Faculty member who is assigned duties in excess of the maximum of the relevant academic credit equivalent (ACE) range specified in Article 32, or in excess of three ACEs in a summer session, shall be compensated for excess units at the rate of $550 per ACE if the academic year appointment is 9 months of salary or more. Payment will be proportional for contracts other than nine months.

43.10. Off Campus Travel Compensation

Unit A compensation rates (Article 29) are applicable to Unit B employees teaching courses for which the compensation applies.

Article 44: Unit B Civil Service Employees

44.1. No provision in this Agreement shall diminish any rights or benefits provided by Civil Service for Civil Service employees.

44.2. Civil Service employees will retain annual leave, sick leave and bereavement leave benefits under Civil Service provisions.

44.3. Civil Service employees will receive the Unit B salary increases negotiated in this Agreement.

44.4. Civil Service employees will follow Unit B timelines and evaluation criteria and procedures.

44.5. Where procedures differ between Civil Service and Unit B (including but not limited to sanctions, termination, and grievance articles), any Unit B Civil Service employee initiating or subject to such procedures may choose which to follow: Civil Service or Unit B Agreement procedures.
